Terms and Conditions
These terms explain how SearchCue works, what you are responsible for, and how subscriptions, AI answers, and AI answer top-ups are handled.
Acceptance
These terms and conditions govern your access to and use of SearchCue, a hosted site search and cited AI answer service operated by DoNoHarm - Bauer & Eide GbR. By creating an account, starting a trial, installing SearchCue, or using the service, you agree to these terms.
If you use SearchCue on behalf of a company, organization, or other legal entity, you represent that you have authority to bind that entity. If you do not agree to these terms, you must not use SearchCue.
Service operation
SearchCue crawls or receives your site content, builds a search index, and serves search results and cited answers to visitors according to your settings. You are responsible for choosing the content you make available to SearchCue and for configuring SearchCue appropriately for your site.
We may update, improve, throttle, suspend, or discontinue parts of the service when needed for security, reliability, compliance, abuse prevention, maintenance, or product changes.
Customer content
Customer content means the site content, configuration, prompts, visitor queries, logs, and related material that you or your visitors provide to SearchCue. You keep ownership of your customer content.
You grant us the rights needed to host, process, crawl, index, display, analyze, and transmit customer content so we can provide, protect, troubleshoot, and improve SearchCue. You must have the rights and permissions needed to provide customer content to the service.
AI answers
SearchCue can generate AI answers using content from your site and related indexed material. AI answers may be incomplete, inaccurate, delayed, or unavailable, and every important answer should be checked against the cited source material.
You are responsible for how you enable AI answers, what content is available to them, and whether generated answers are appropriate for your site, visitors, legal obligations, and professional standards. SearchCue is not a substitute for legal, medical, financial, or other professional advice.
Billing and Paddle payments
Fees, quotas, billing periods, taxes, and plan limits are shown at checkout or in your SearchCue account. You authorize us and our payment providers to charge the payment method associated with your account for subscriptions, renewals, plan changes, top-ups, overage, taxes, and other applicable charges.
Where Paddle is used at checkout, Paddle acts as reseller or merchant of record for the payment transaction, handles applicable transaction taxes and order support, and Paddle's buyer and refund terms may also apply. These DoNoHarm product terms still govern access to and use of SearchCue.
If payment fails or a subscription is cancelled, expires, or becomes invalid, we may limit, suspend, or end access to paid features. You remain responsible for charges properly incurred before cancellation or suspension.
AI answer top-ups
AI answer top-ups are one-time charges for additional AI answer usage inside the service. They are not money, electronic money, stored value, virtual currency, store credit, a gift card, a voucher, a deposit, or a cash-equivalent balance.
They cannot be transferred, withdrawn, redeemed for cash, resold, or used outside SearchCue. They are consumed only by additional AI answer usage for the relevant SearchCue site or account, subject to the active subscription, site settings, and applicable law.
Top-ups do not create any right to a cash refund, cash redemption, withdrawal, or transfer. If access to the relevant site, account, or subscription ends, the associated top-up allowance may no longer be usable unless applicable law requires otherwise.
Acceptable use
You must not use SearchCue to break the law, infringe rights, bypass access controls, scrape content without authority, attack systems, distribute malware, spam users, mislead visitors, or process content that you are not allowed to provide to the service.
You must not use SearchCue to generate, host, or distribute unlawful, abusive, deceptive, or harmful material. We may investigate and restrict use that appears to create security, compliance, operational, payment, or reputational risk.
Intellectual property
SearchCue, Monocle Search, DoNoHarm, our software, designs, trademarks, documentation, infrastructure, and related materials are owned by us or our licensors. These terms do not transfer any ownership rights to you.
Subject to these terms and your paid or trial plan, we grant you a limited, revocable, non-exclusive, non-transferable right to use SearchCue for your own authorized sites.
Privacy
Our processing of personal data is described in the SearchCue privacy policy. You are responsible for providing any privacy notices, consents, cookie notices, and data protection documentation required for your own site and visitors.
You must not provide sensitive personal data to SearchCue unless your plan, configuration, and written agreement with us expressly allow it.
Third-party services
SearchCue may rely on third-party infrastructure, payment processors, analytics, model providers, email services, hosting providers, and browser or platform APIs. Third-party services may have their own terms and availability limits.
We are not responsible for third-party services outside our control, but we will use reasonable care in selecting providers that support the operation of SearchCue.
Availability
We aim to keep SearchCue reliable, but the service may be interrupted, delayed, degraded, or unavailable because of maintenance, incidents, provider failures, network problems, abuse prevention, legal requirements, or events outside our control.
We may set reasonable technical limits to protect the service, including crawl limits, rate limits, query limits, storage limits, and usage controls.
Warranty disclaimer
SearchCue is provided on an as-is and as-available basis to the fullest extent permitted by law. We do not promise that the service will be uninterrupted, error-free, fully secure, or suitable for every site, visitor, purpose, or regulatory requirement.
Any examples, previews, estimates, pricing summaries, or usage projections are informational unless they are expressly part of a confirmed checkout or written agreement.
Liability
To the fullest extent permitted by law, DoNoHarm will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, loss of goodwill, or business interruption.
To the fullest extent permitted by law, our total liability for claims relating to SearchCue is limited to the amounts you paid for SearchCue during the one month before the event giving rise to the claim. Nothing in these terms limits liability that cannot be limited under applicable law.
Indemnity
You agree to indemnify and hold DoNoHarm, its partners, team members, and service providers harmless from claims, losses, damages, liabilities, costs, and expenses arising from your customer content, your sites, your use of SearchCue, your breach of these terms, or your violation of law or third-party rights.
Disputes
These terms are governed by the laws of Germany, without regard to conflict of law rules. Courts in Germany will have jurisdiction over disputes relating to these terms or SearchCue, except where applicable consumer law gives you mandatory rights in another jurisdiction.
Before starting a formal dispute, please contact us so we can try to resolve the issue directly.
Changes
We may update these terms from time to time. When we do, we will update the date on this page or provide another reasonable notice. Continued use of SearchCue after updated terms take effect means you accept the updated terms.
